• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES;

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE OR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO JET'S PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law.

To the extent that any dispute is not subject to mandatory arbitration as set forth in Section 10 below, you consent to the exclusive personal jurisdiction and venue of the federal and state courts located in the United States for the resolution of any dispute arising under or related to these Terms. You waive any objection to jurisdiction or venue in such courts.

For customers located in California, additional rights may apply under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), Cal. Civ. Code § 1798.100 et seq., and the California Consumer Legal Remedies Act (CLRA), Cal. Civ. Code § 1750 et seq. Nothing in these Terms is intended to limit or waive any rights you may have under California law or the law of any other state.

These Terms are also subject to applicable federal law, including the Federal Trade Commission Act (FTC Act), 15 U.S.C. § 41 et seq., which prohibits unfair or deceptive acts or practices in commerce. 10. Dispute Resolution

10.1 Informal Resolution

We will make reasonable efforts to resolve the Dispute informally within thirty (30) days of receipt of your notice. The arbitrator shall have the authority to award any remedy that would be available in a court of law. The arbitrator's decision shall be final and binding on both parties, and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

Each party shall bear its own costs and attorneys' fees, except that the arbitrator may award costs and fees to the prevailing party to the extent permitted by applicable law.

10.3 Class Action Waiver

YOU AND JET'S PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. If a court or arbitrator finds this class action waiver to be unenforceable in whole or in part, then the arbitration provision shall not apply to that claim.

10.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction in the United States to prevent irreparable harm pending the outcome of arbitration. Either party may also bring an individual action in small claims court for disputes within the jurisdictional limits of such court.
